Welcome to Abalooba, the first email directory!
Before you utilize Abalooba or create an Abalooba listing, you must read and consent to the Abalooba Terms of Use and Conditions of use. You also agree to any future amendments to these Terms of Use and Conditions of use.
We reserve the right to change the Terms of Use or Conditions of use at any time. Abalooba suggests that you visit this page periodically. If you do not consent to the changes please withdraw your information from the directory. Nothing in this Agreement shall be deemed to confer any third party rights or benefits.
1.	Description of Service. Abalooba is a free, search-based directory application from Abalooba (the "Service"). Abalooba provides the service as is.  By providing your contact information to Abalooba, including an email address to Abalooba, you realize others will gain access to the information you provided.
2.	You understand and agree that the Service is provided on an As is and the service will be provided when it is made available.  You agree Abalooba has no responsibility or liability for the availability, timeliness, security, accuracy, or reliability of the Service. Abalooba reserves the right to modify, suspend or terminate the Service at any time with or without service and without any liability to you. 
3.	Personal Use. The Service is made available to you for your personal use only. We do not ask children under age thirteen (13) for their personal information.  AS A CONDITION OF PARTICIPATION you must be at least 13 years of age to use this service.  You must provide current, accurate identification, contact, and other information that may be required as part of the registration process and/or continued use of the Service
4.	Proper Use. You agree that you will not request more than one (1) email address or other contact data at any one time. And you will not send out spam to any emails you obtain from Abolooba. Violation of any of the foregoing may result in immediate termination of your right to use Abalooba, and may subject you to state and federal penalties and other legal consequences. Abalooba reserves the right, but shall have no obligation, to investigate your use of the Service in order to determine whether a violation of the Agreement has occurred or to comply with any applicable law, regulation, legal process or governmental request. 
5.	Content of the Service. Abalooba reserves the right at all times to remove or refuse to distribute any contact information or other content.  Abalooba will not be responsible or liable for the exercise or non- exercise of its rights under this Agreement. 
6.	Intellectual and Other Property Rights.  You acknowledge that Abalooba owns all right, title and interest in and to the Service, including without limitation all intellectual property rights (the "Abalooba Rights"), and such Abalooba Rights are protected by U.S. and international intellectual property laws. Accordingly, you agree that you will not copy, reproduce, alter, modify, or create derivative works from the Service. You also agree that you will not use any robot, spider, other automated device, or manual process to monitor or copy any content from the Service other than for personal use and limited to no more than fifty (50) names. The Abalooba Rights include rights to (i) the Service developed and provided by Abalooba; and (ii) all software associated with the Service, the database of contact information, the data itself, the format of the data and the order in which data is displayed as is consistent with the intellectual property laws as applied to other directory type services.  By providing your contact information to Abalooba, you are granting a license to Abalooba to distribute and publish your information in Abalooba. 
7.	Your Representations and Warranties. You represent and warrant that (a) all of the information provided by you to Abalooba is correct and current; and (b) you have all necessary right, power and authority to provide this information to Abalooba.  To be clear you shall not provide others contact information without proper authorization.
8.	Privacy. As a condition to using the Service, you agree to the terms of the Abalooba Privacy Policy published here.  It may be updated from time to time. Abalooba understands that privacy is important to you. Abalooba collects information when you register with Abalooba.  Abalooba may automatically collect information on our server logs, including your IP address.  Abolooba may use cookies in the future.  Abalooba will distribute your contact information to people who request it- like a telephone directory- however Abolooba may provide controls to restrict "spammers" or potential "spammers" access to contact information.  Abalooba will comply with any governmental requests for information Abalooba in its complete discretion deems reasonable.
9.	Advertisements. Since Aballoba is not charging you for the service you agree that Abalooba may display ads and other information in various places in the directory.
10.	Fresh Information. From time to time Abalooba may as people to respond to an email indicating their contact information is current.  Abalooba reserves the right to delete contact information or move it to "not recently verified directory" at any time.  If contact information has been delisted or moved for non response you may resubmit accurate contact information.
11.	Publicity. Any use of Abalooba's trade names, trademarks, service marks, logos, domain names, and other distinctive brand features ("Brand Features") must be in compliance with this Agreement and in compliance with Abalooba's then current Brand Feature use guidelines, and any content contained or reference therein, which may be found at the following URL: http://www.abalooba.com/permissions/guidelines.html (or such other URL Abalooba may provide from time to time).
12.	Termination; Cancellation. You may cancel your use of the Services and/or terminate this Agreement with or without cause at any time by providing notice to Abalooba at http://www.abalooba.com/accounts/ManageAccount; provided, however, that a terminated account may continue to exist for up to two weeks before such cancellation takes effect. Abalooba may at any time and for any reason terminate the Services to everyone or to you .  Residual copies of contact information may remain in our system.
13.	Indemnification. You agree to hold harmless and indemnify Abalooba, and its subsidiaries, affiliates, officers, agents, and employees from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, Abalooba will provide you with written notice of such claim, suit or action.
14.	Choice of Law; Jurisdiction. These Terms of Use will be governed by and construed in accordance with the laws of the State of California, without giving effect to its conflict of laws provisions or your actual state or country of residence. Any claims, legal proceeding or litigation arising in connection with the Service will be brought solely in San Diego County, California, and you consent to the jurisdiction of such courts.

Please note that we may change our policies at any time, and pursuant to our Terms of Use, it is your responsibility to keep up-to-date with and adhere to the policies posted here.  We may suspend or terminate this service at any time to the public or to you.  You agree you will not hold Abalooba responsible for any type of damages.
